Resumo: | Law, as a discourse, goes from a positivistic justification of validity to a procedural justification that is inspired by the Discourse Theory, thus the repercussion of such transition over the rule of law exerts this paper to review Hans Kelsens positivistic norm concept under a procedural perspective. The objective is to contribute to a conception of norm that conciliates the tension between bindingness to current law and appropriateness to specific cases. From Hans-Georg Gadamers philosophical hermeneutics and his dialogue with Jürgen Habermas, this paper addresses the topic in a comprehensive-reflexive manner. Referring to Pierre Bourdieus logic of Law, it draws a parallel between the positivistic discourse of Kelsen and Herbert Hart and the procedural discourse of Robert Alexy, Ronald Dworkin, Klaus Günther and Habermas. Since Kelsen conceives the norm as meaning, this paper specifically discusses the differences between the interpretation conceptions in the two discourses, making considerations of literary criticism and Semiology. Finally, the comparison between the two conceptions of legal norm leads to the conclusion that the predicate of Kelsens conception of norm is not incompatible with the procedural discourse, but its substance as an objectively given meaning should yield to an intersubjective meaning dialogically constructed. |
