Resumo: | This study seeks to investigate what is the treatment given by the Children and Adolescent to young people who are in conflict with the law. In the meantime, we sought to investigate the flow of operation of the juvenile justice system in Belo Horizonte, in order to know the extent to which judges, prosecutors, defenders, prosecutors, technicians and educators take into account the personality and characteristics of adolescent your family when applying for social and educational measures. The survey presents a review of literature affects the sociology of crime and misuse with an emphasis on symbolic interactionism and ethnomethodology, and the bibliography of studies on juvenile justice in Brazil. It also presents a brief historical retrospective on the construction of criminal responsibility of adolescents in Brazil, from the time of the Empire until the promulgation and validity of the ECA. Several research methods were used in order to combine quantitative and qualitative data. In-depth interviews were conducted with 14 legal operators, participant observations in 80 hearings, three focus groups, in addition to the statistical analysis regarding the two databases, one of them with 9.605 entries with 1.842 adolescents and other adolescents The survey results show that the new modus operandi of juvenile justice in Belo Horizonte has managed to give vent to the speedy processing of the violation, bring some benefits for adolescents in conflict with the law and their families. However, there are still several flaws in the system, especially as regards the implementation of socio-educational measures. |
