The creation and evolution of the patent system in the world has been driven by several factors and interests. Over time, several factors influenced the modifications of the patent system and the conformations that he was adopting caused many questions, including of the relevance of it and the contribution that he could bring to the users nations. The social function of intellectual property under the Constitution of the Federative Republic of Brazil, indicates that patents have, as purpose, serve the social interest and technological and economic development of the country. In this sense, it is essential to the evaluation of compliance of these goals. The current situation allows us to assess the main challenges for which the patent system passes these days and also allows to evaluate the performance of the great nations in relation to the use of the patent system and to infer some of the aspects in which Brazil should invest to take more advantage of the system.
