Resumo: The Constitution of the Federative Republic of Brazil began a democratization process of the Brazilian trade union system, though not completed. It still remains undemocratic postulates as unicidade sindical, syndicalism by category, minimum territorial base and compulsory trade union dues. To overcome this model, trade union is analyzed based on the dignity of the human person as its fundamental, in which articulates freedom, equality and democracy in a substantial sense, and the struggle for the recognition of rights as its end. From these basic aspects of trade union, freedom of association is recognized as a human right whose integration takes place, either by its material sub-jects in treaties ratified by Brazil, either by the fact that Brazil is member of international organizations that protects freedom of association as a principle or fundamental right. This integration uses Erik Jayme's Theory "Dialogue des Sources" combined with pro homine principle. Once recognized freedom of the association, it is analyzed all its effects on institutes of the Brazilian trade union law, breaking definitively with the cor-poratist trade union model.
