It proposes a reflection about education in prison establishments beyond its proposal as a means of punishment and/or process of social reintegration, seeking to achieve the idea that the offer of this teaching is imperative as an element of personal and social development of people in deprivation of liberty. Considering that the research has a clipping focused on the Penitentiary System of the State of Maranhão in its male and female units, this research characterizes the socioeconomic, ethnic and educational profile of the men and women in the System in order to understand part of the phenomenon of crime in the state. This research identifies the conditions of the facilities of the Prison Unit for Female and Male Resocialization of Pedrinhas-MA and the relationship between the legislative determination and the reality experienced by its inmates based on the analytical perspective of Italian philosopher Giorgio Agamben discussing the need to protect human rights from persons deprived of liberty. Subsequently, the research is proposed to present the regulatory framework of the teaching offer in prison establishments and their educational and legal aspects, based on the education guidelines and the rules on penal execution discussing the importance of the right to education. Finally, based on the Development as Freedom theory of Amartya Sen, it is intended to argue about the importance of education in prison establishments as a tool for developing the capacities of the inmates, favoring the personal and social development. |
