The system of precedents systematized in the CPC of 2015 began to demand specific and adequate measures from the judicial body, both for the identification of situations in which the application of precedent is appropriate (granting of urgent relief, injunction of groundlessness, etc.) and for the finding of repetitive cases without precedent signed, which, in the light of the concrete case and from the perspective of case management, will require a different attitude from the judge. Thus, the line of work to be developed in the proposed research will be based on the system of precedents, in the light of case management, through the study of possible measures to be taken by the judicial body in view of the new provisions affecting the subject and that may contribute for greater procedural efficiency. The objective is to correlate judicial measures and postures related to the management of cases involving mass litigation, which may positively influence the consolidation of the system of precedents in the local court and, with this, help to mitigate the crisis of effectiveness still so present in the justice system. |
