Resumo: | A major problem today when the issue is environmental licensing is the issue of decentralization. Decentralization is launching a new policy on the issue of the environment, reducing the schedule of state licensing agencies, which are now overloaded with licenses that could be being made by municipalities, causing delay in the issuance of licenses, which harms including development of States. Therefore, this dissertation is to evaluate the process of decentralization of environmental licensing in the city of Rio de Janeiro, due to the new decentralization model being provided by State and City partnership aimed at increasing the effectiveness of environmental control, simplifying and streamlining the procedure environmental licensing, identifying advantages and disadvantages in order to contribute to the improvement of the process of corporate environmental management. To give focus to the problem in order to survey data, we evaluated the differences in technical readiness, doctrine, beyond the case study on environmental decentralization in Municipality of Rio de Janeiro, since, through a study specific, would be shown the causes of environmental licensing, focusing on the legal situation in the Brazilian legal system. Furthermore, it was also used to search bibliographic on the subject, as well as interviews with environmental managers and contacts with environmental agencies conducting the environmental licensing. In the result and discussion of the work presents the evaluation of the results obtained in the doctrine and jurisprudence, and the responses obtained on the service conditions of the agreement signed and answers of environmental managers of the companies evaluated. Despite the small number of companies in the survey, it can be concluded that even with some benefits in municipal environmental licensing, no immediate gains in corporate environmental management system was observed |
