Resumo: This dissertation has the aim to study the policies related to the treatment of drug users and ilicit drug addicts in Brazil. The investigation relies on the analytic-descriptive method and has as its parameter the literature and documental review. First, the history of the drug laws emergence in the world and in Brazil is presented, with subsequent analysis of the national drug policy evolution, in which it is possible to perceive a repressive position over the years. However, changes are observed in this scenario in the past decades, mainly in European countries, with the adoption of alternative policies such as harm reduction. A strategy also used in Brazil, being one of the guidelines of the Ministry of Health policies for Integral Attention to Alcohol and Other Drugs User, implemented in 2003. This policy represents a major advance in the prevention, treatment, rehabilitation and social reintegration of users and drug addicts, establishing the construction of an integral attention network articulated and with cross-sectoral characteristics, which seeks to consolidate a model of open and community-based care. At the end of this work are presented existing divergent positions in the country about the proposal for compulsory hospitalization for treatment of drug addicts, the law applied and the characteristics of this institute.
