The debate about the institution of divorce in Brazilian legal system began, still in the century XIX, becoming subject again in several opportunities, however, it got intensified from the 1940's on. Starting from juridical writings, the present work carehes to build the way that led to dissolution of matrimonial bonds, showing social chatuges and its links to juridical national field. During the four decades studied (1940, 1950, 1960, 1970), the writings of people for and against divorce were marked by the defense of the family. Occupying opposite fields people for and against dissolution discussed juridical, social and religious aspects relevant to the possibility of institution of divorce in the country. It was always present in this debate the role ofthe family in Lhe society, its pattern of organization and the role attributed to men and women.
