This Master s dissertation was developed in the Criminal Sciences Graduate Program, under the line of research on Contemporary Criminal Legal Systems. Its goal is the revaluation of the Brazilian Law normative contents in order to safeguard the constitutional guarantees of those charged with administrative corruption through due process of law, in the sense of a fair trial. The paper seeks a balance between garantism constitutional requirement and the social need of protection against violations expressed in Article 37, § 4º, of the Constitution, as a requirement of guardianship of legal interest. To this end, it is identified the subject matter of protection of the rule, the nature of the violation and the penalties, especially suspension of political rights. It is assessed the basic structural features of civil procedural law and of criminal procedural law to determine the (in)compatibility of each with the specifics of the violation of administrative corruption and with the accountability requirements for the agent. Finally, we conclude, based on the case law of the European Court of Human Rights and the Inter-American Court of Human Rights and on the theory of substantive due process of law by the need for proper procedural systematics, neither civil nor criminal, for determining the violation focused on the legal system of sanctioning administrative law even when judicialized. |
