In this doctoral dissertation I propose the study of Act 11.284/2006, called General Act of Public Forests, and its compatibility with the fundamental legal positions set forth in the environmental constitutional right. I analyze the theoretical and dogmatic aspects relating to the constitutional environmental right, observed as a complete right that contains a structure of right and duty, and the legal elements of the General Act of Public Forests, considering the division that the Act makes of three forms of management of public forests: direct by the State, by destination to local communities and with forest concessions. Also, I take notice of the importance of the normative provisions, legal concepts and judicial decisions related to the subject, which are part of this research. The method of approach used is the hypotheticaldeductive, by which the compatibility of the General Act of Public Forests with the constitutional environmental right is examined, based on a structure of investigation that verifies this and other hypotheses formulated in the text. I conclude that, besides the compatibility, the General Act of Public Forests promotes the realization of the constitutional environmental right. |
