Resumo: |
In order to facilitate the sustainable exploitation of forest resources, the Federal Law 11.284/2006 innovated the Brazilian legal system by introducing three different mechanisms of public forest management system, namely: the direct management by the Government, the allocation to local communities and the forest concession. As is inherent to every legal innovation, the implementation of the mechanisms provided by the above mentioned law has been involved in discussions on the doctrine and jurisprudence, reflecting even on the discussions about the unconstitutionality of some of its articles. This paper proposes a thorough analysis in order to clarify controversial aspects of the Law of Public Forest Management implementation addressed by doctrine and jurisprudence, and seeks their conformity to the principle of sustainable development |
