Resumo: The number of guidelines on the subject, properly interpreted, guides both jurist and collective groups to value collective negotiation in defining working conditions and to exercise it as a democratic form of harmonious and committed consensus. In addition to promoting social peace, it contributes to reducing the process of weakening unions, valuing worker organizations, and is fundamental to reducing social disparities and strengthening citizens' self-confidence and skills. The role of unions is essential in formulating standards that ensure significant cohesion between the working classes and enable fair and balanced working conditions, thus exercising their highest and noblest function. Surely, this is the most effective approach to resolving conflicts and issues between capital and labor. Throughout the research, it is proven that there is no other legal method more suitable, opportune and advantageous than collective labor negotiation in order to implement the social right to the inclusion of apprentices. Learning is a public policy that certainly impacts several problems in society: education, reduction of violence, unemployment, poverty and social inequality. Companies benefit from the productivity resulting from a better qualified workforce, including a reduction in the number of illnesses and accidents at work. Society gains from better qualified workforce, has the opportunity to include teenagers in situations of greater social vulnerability, reduces school absenteeism and functional illiteracy and encourages economic growth. Legislation on learning has provided several advances to Brazilian society, however, significant challenges remain to be faced. One of the main ones, in fact, is to prevent setbacks in learning as a public guideline of the Brazilian State aimed at the insertion of teenagers and young workers into the job market. And it is exactly at this point that this research is justified, as collective bargaining (through its primary functions) becomes a valuable opportunity for the field of labor law, playing a vital role in guaranteeing the rights of apprentices, ensuring that their educational experiences are enriching. and free from exploitation
