This dissertation analyzes the development of the union representation’s pattern as well as the collective bargaining agreements in Brazil, addressing the last ones as a self-compositive way used either in order to solve conflicts or to conquire colective pretensions in the context of the labor relationships. Moreover, it analyzes the legal structures of such pattern relating them with the current context of the unions’ crisis in Brazil, due to certain changes about the labor legislation that led it to the consequent changing of the treatment given to some historical elements within the union’s relationship. At last, this dissertation aims to promote the study of the importance of the employees’ collective representation in the workplace, not related to the unions, analyzing the so called atypical collective bargaining agreements as a result of direct debates and understanding between the employees and employers, with no participation of the respective unions, pointing out such procedures as a valid alternative for granting fundamental rights |
