The special urban adverse possession through abandonment of conjugal home, simply referred as family adverse possession, was introduced into Brazilian legal system as a kind of special urban adverse possession, based on the social right to housing and in the principle of social function. In spite of the identity of some requirements, the existence of other very different ones transform familiar adverse possession into a sui generis institute. In this study, besides the analysis of the subjective, objective and formal elements of familiar adverse possession, we intend to examine the way in which the right of property is acquired. In summary, as the main statement, it is proposed that family adverse possession is a derivative way of acquiring property, provoking simple transmission of an existing right. This conclusion, constructed throughout this study and confirmed at the end, places the familiar adverse possession under a new perspective, with several practical applications. In particular, it sheds light on the study of the effects produced by adverse possession on the right of property and on the other property laws of fruition and guarantee |
