Resumo: |
This Dissertation examines the issue of match-fixing and its impact on the integrity and unpredictability of professional sports, with a focus on the legal implications in Brazil. The research explores both lex publica and lex sportiva, analyzing judicial decisions from Sports Courts and examining landmark cases. The Dissertation begins by addressing match-fixing as a global phenomenon tied to fixed-odds betting (Bets), which presents regulatory challenges both domestically and in terms of international cooperation. Next, the Dissertation evolves to characterize sport as a distinct social subsystem governed by its own legal framework, lex sportiva, which, when operates alongside state law, faces difficulties in safeguarding the integrity of competitions. The Dissertation then evaluates the Brazilian sports legal system to determine its effectiveness in addressing these issues. The final section contributes to the systematization of sports governance, emphasizing the importance of prevention strategies and policies to combat match-fixing. In conclusion, the Dissertation calls for stronger integration between state and sports jurisdictions to enhance sports regulation in Brazil and ensure the fairness of competitions |
