This work is about the analysis of the function of the police as a guardian of society. This is related to the study on the legal nature of this institution with the unity of the law, making up such an analysis in the social sphere. In this context, released the following research questions, which assisted in the completion of a theme that does not end in itself, they are: What is the legal nature of the police? What is the function of the police in society? As the police should do if or trigger conflicts of interest between the company and the state? As citizens, individually considered, what the police should do in conflicts of interests between the society and the state? Even in the face of these questions, some others are inevitable for a conclusion not only logical, but also consider the current needs of a society that claims for justice, and wrongly attributes the rise in crime to law enforcement agencies. So, this work seeks, in a historical and contextual analysis, reveals the real problems facing the society, and here we present concrete and logical conclusions, especially laws about the problem of the crimes, in a review in the legal system. We used the logical and systematic method, with a qualitative approach, researching dates, books, articles and interviews, based on the best authors, which expresses the multidisciplinary nature of this work. Finally, the general objective outlined in this work is to outline the main issues of security and public order, being engaged in the measures to be short, medium and long term adopted by analyzing the lines put into action, with the necessary changes in the legal system and also taking into account the awareness of society, because it s clearly the essential function of the police as a guardian of the whole State
