Resumo: The present study analyzes the limitations on the judgment of the Appeal, by the Superior Court of Justice, due to the provisions of art. 105, III, of the Federal Constitution. The study examines the models of Courts existing in the world, as well as the functions performed by these courts, to analyze the functions performed by the Superior Court of Justice. The general theory of Appeals is also analyzed in order to understand the Appeal to the Superior Court of Justice. Furthermore, it analyzes the relation between the admissibility, cassation and review of the Appeal, as well as the characteristics of the Appeals of related grounds. Then, it analysis the constitutional limitations to the judgment of the Appeal, an opportunity to discuss the admissibility of knowledge of matters of public policy, other grounds of defense not appreciated by the local Court and the other evidences
