The International Convention of New York is a universal diploma, whose purpose is to protect the rights and guarantees of persons with disabilities, enabling them to carry out the acts of civil life in the same way as the other members of society. Brazil, feeling the need to safeguard the rights of persons with disabilities, ratified the law in 2008, with constitutional amendment status, ensuring the integration of international precepts to the internal order, mainly, by editing the Statute of the Person with Disabilities in 2015. In view of the hierarchical superiority of the treaty, the Statute amended and / or revoked everything that was not compatible with it, and one of the most affected legislation was the Civil Code, as regards the theory of disabilities, welfare institutions and marriage. Among the many modifications, we propose, in the present work, to point out the changes undergone by marriage, starting from the transconstitionalism and the sharing of information; through the analysis of the New York treaty and its reception by the ordination, arriving properly at the changes suffered by the marriage, such as the ability to convolvulate nuptials, the declaration of will; the regime of nullities and, finally, the effects of marriage. From then on, we will be able to elucidate the conflicts between civil legislation and the protection of persons with disabilities, by means of a comparison of foreign laws, enabling an adequate and conscious positioning, always with a view to guaranteeing the dignity of the human person and without prejudice to the legal certainty of the company |
