The presente research is dedicated to the study of binding decisions regading the Public Administration. The binding decisions were introduced in Brazil in order to solve repetitive litigation, to simplify the decision-making process and to guarantee legal certainty and isonomy in the jurisdictional rendering. Since the provision of public services generates a large part of the judicial conflicts, it is necessary to understand what the impacts of the binding decisions are on the administrator. First of all, it must be understood that binding decisions are normative texts, and as such are always subject to interpretation and are not applied through a mere process of subsumption. The formulation of binding decision is therefore an exercise of atypical legislative activity by the Judiciary. As some binding decisions have no prediction in Constitution, naturally questions related to their constitutionality arise. Facing CPC / 2015 927 in all its interpretative possibilities would lead to the fatal conclusion that it is an unconstitutional device. It is therefore imperative to carry out na interpretation of this article according to the Constitution in order to harmonize it with the constitutional principles, especially the separation of powers and the adversarial and legal defense principles. At the end, it is possible to propose a constitutional use of CPC / 2015 927, which makes it, concerning the Administration, a true inducement of institutional dialogue. |
