The work defends the legal nature of trade secrets, proposing their qualification as a real property right (intellectual property). It investigates the origin, concept, justification, applicable legislation, legal nature, and inherent limitations of the main intellectual property rights recognized by law. The thesis then analyzes trade secrets themselves, covering their history, concept, differences from other legal institutes, legislation, justification, and intrinsic limitations. Additionally, it examines case law and various theories related to their legal nature, rejecting the possession theory and discussing the applicability of the erga omnes effect and the numerus clausus theory, both often cited as obstacles to qualifying trade secrets as a real property right. In the third part, the thesis examines property rights, their social function, the flexibility of the erga omnes effect (which is absent in other intellectual property rights), as well as the mitigation of the numerus clausus principle, mitigated by social function and autonomy of will. It concludes that trade secrets can indeed be framed as a real property right.The thesis concludes by presenting the legal, social, and economic advantages of this classification for the business environment and judicial protection of trade secrets |
