Resumo: This doctoral thesis is the product of a scientific investigation developed within the Postgraduate Program in Law of the Pontifícia Universidade Católica de São Paulo, Brazil, about the efficaciousness of collective rights and the tutelage of collectivity, peoples and mankind. The research analyzed the dynamics of new labor forms in postmodern society through the development of new technologies, especially those involving the relationship between car drivers and companies that connect passengers through computer applications. The purpose of the research is to examine whether the hiring of private car drivers through a system of computer applications for smartphones and tablets, such as the UBER technological platform, can lead to the conclusion that the risk of the enterprise is being transferred to workers as a means to dissimulate the existence of subordinated labor relationships? The materialistic dialectic method and quantitative/qualitative research will investigate the evolution processes and labor insertion within the capitalist production system, indicating the dynamic given by labor items such as prime matter, production means and labor force; the role of the constitutional and specific principles of labor legislation and the general clauses in the law´s interpretations; the constitutive presuppositions of labor hiring relationship, with special emphasis on the developmentof the concept of disruptive juridical subordination. Decisions by Brazilian and foreign Courts will be analyzed and investigated as from data collected from the worldwidenetwork of computers. Affidavits by witnesses in the Public Civil Inquiry number 001417.2016.01.000/6 of Labor Prosecution Office of the First Brazilian Region, the real characteristics of the activities developed by drivers using the UBER eletronic platform will be defined and analyzed
