This dissertation aims to study the legal nature of the employment relationship between app drivers and the company Uber, analyzing the feasibility of classifying this relationship as employment, as a sufficient means of placing these app workers under the supervision and regulation which are specific to and originate from Labor Law. To this end, the current function of Labor Law will be analyzed, through normative evolution over time, as well as the evolution of work over the years, especially with the advent of technology, demonstrating how work by application emerged and what the true working conditions. Finally, the elements that make up the employment relationship were studied, comparing them to the reality of the work carried out by app drivers, aiming to classify these workers as employees. This demonstrates that there is no need for new legislation for workers in this class, and they must therefore be protected by Labor Law. To increase the work, the deductive-hypothetical method was used with bibliographic, documentary, jurisprudential and legislative analysis on the topic |
