A influência do capitalismo neoliberal na formação jurídica do Brasil: uma análise marxista

Resumo: The research object of the study was the neoliberal capitalist influence in the philosophical formation of the legal professional. The purpose was to demonstrate the importance of Marxist theory for a broader intellectual formation, in order to guarantee the plurality of thoughts existing in society. The research is justified by the relevance of creating social alternatives to the problems generated by capitalism, emphasizing the importance of Marxism, a social theoretical current consolidated in the scientific world. The study was developed in two parts, the first presented the Marxian assumptions, demonstrating the dialectical historical materialist method and its application in research, then the historiography of legal analyzes existing in Marx's works, demonstrating that the author is fundamental for legal education. In the second part, he presented the contemporaneity of the philosophical thought and its economic and political influences. Given the complexity of the subject, it opted for a didactic division, respecting the tripod developed by Engels, with philosophical, economic and political criticisms, successively in different chapters. As for the philosophical part, it synthesized the three contemporary legal philosophical currents: legal positivism, non-juspositivism and critical theory. In the economic part, he presented the Marxian thought regarding the structural analysis of society, demonstrating the influence of neoliberal capitalism on the social structure and the impacts on the educational formation of legal education. Finally, in the political part, he demonstrated that the country's intellectual formation is supported by economic policy, highlighting standardization and mechanization in the curriculum of graduate courses in Law. It concludes by proving through theoretical and empirical research that legal education education has a liberal hegemony in Brazilian thought, leaving little room for the Marxist critique that proposes changes in the capitalist system
