Os fundamentos da ordem econômica sobre a recuperação judicial como instrumento de defesa da dignidade da pessoa na perspectiva do capitalismo humanista

Resumo: This study aims to investigate the harmonization and correlation between the constitutional economic norm, its principles and foundations, in line with the infraconstitutional legislation for the preservation and restructuring of companies, from the perspective of humanist capitalism. Thus, we established the theoretical bases necessary to determine the correlation between the constitutional economic order and the principle of company preservation, a principle set forth in Law 11,101/2005, including its application and limits, in order to establish judicial recovery as an efficient instrument for the protection of human rights. Through the analysis of the concept and objective of judicial recovery, which is in full compliance with the economic matrix rule, we find that, by making it possible to overcome the situation of economic and financial crisis of a company affected by these difficulties, this institute becomes an important instrument for the protection of human rights and, above all, a guarantee for the dignified existence of all in full compliance with the principles and foundations laid down by the Constitutional Economic Order, from the point of view of humanist capitalism. In order to approach the theory of humanistic capitalism, which was accepted by judicial recovery, the concepts of economics and economic order were investigated, presenting the design of this theory, through its theoretical framework, which supports the realization of human rights in all its dimensions – liberty, equality and fraternity – but also the quantum application of Law as a way of effecting human and fundamental rights, which brings to juridical science the concept of consubstantiality, which underpins normative jus-humanism.
