Resumo: This dissertation aims to analyze the principle of legal certainty and modulation of the effects of decisions of the Supreme Court, which declare the unconstitutionality of laws or normative acts, in a case of concentrated control of constitutionality through the way of action. To this end, the analysis of the doctrine about the concept of legal certainty was carried out. Moreover, a survey was carried out on the effects of the decisions of the Supreme Court, which declare the unconstitutionality of laws or normative acts, in a case of concentrated control of constitutionality through the way of action, in order to establish its everyday effects and to understand the legal requirements for the realization of modulation. In addition, an analysis of cases of concentrated control were performed, including actions declarations of constitutionality, direct actions of unconstitutionality and accusations of non-compliance with fundamental precept, distributed between November 10, 1999 and July 31, 2022. Which correspond to about 6,000 cases. Thus, among those processes in which there was a final decision, approximately 200 actions were identified in which the effects were modulated. After this preliminary analysis, we were able to establish some general lines, that is, cases with similar characteristics. Thus, we can identify cases in which the Supreme Court is more likely to modulate the effects of decisions. Some interesting cases were screened, which were commented throughout the work. All, to better understand the situations in which the Supreme Court usually modulates and understand so the modulation of the effects of decisions given in constitutionality control ensures greater legal certainty
