Resumo: The aim of this study is to defend the theory that the Law interpretation and application must take place in accordance to axiological and social-political perspectives. It tries to show that the Law application involves ethical and political aspects that the knowledge of the rules itself is not able to face. Because of this, the judge has a very important role in achieving justice, the greatest aim of the Law. Then, it reinforces the idea that the judge is above all responsible for the creation of the Law, which gives him a relevant social role. He has to look for ways to harmonize the law and the social values, according to the Law to Introduce the Rules to Brazilian Law System (art.5th). It is a tendency that leads to the interpretation of the rules by the judge according to the ethics, having the man and the social wishes as the inspirations for Hermeneutics. At last, it defends that the humanistic view of the Law is possible through Pragmatism, a philosophical movement that comes from North America, which supports the rise of scientific knowledge to reality, and when applied to the legal area, creates a new methodological proposal in order to understand the Law problem
