Resumo: The present study analyzes the institute of trade dress – “conjunto-imagem” – in Brazil, which, although not provided for in Brazilian legislation, is recognized by national doctrine and jurisprudence. The institute was analyzed as an act of unfair competition, due to the specific regulatory gap, and for this reason a chapter was created for the topic, covering concepts, historical part, constitutional economic principles and parasitic competition. Next, we delve into the study of trade dress itself, addressing its concept, origin and requirements. In this work, we analyzed some judgments from the bodies of the Judiciary, with emphasis on the Superior Court of Justice (STJ) and the Court of Justice of the State of São Paulo (TJSP), in an attempt to outline the crucial points used in the decisions. In addition, the bill that was processed in the senate number 138/2018 was discussed, which sought to criminalize the act of unfair competition against the overall image of a company. The objective of the work was to improve the topic in search of improvements in the legal protection of the trade dress institute in Brazil
