Resumo: The purpose of this dissertation is to analyze the Social Right to Health provided for in the Brazilian Constitution, its relationship with other Fundamental Rights such as the Right to Life and the solution that the Inter-American Court of Human Rights and the Federal Supreme Court has given to concrete cases when provoked or in case of violation of these essential rights. The right to health has been subject to intense judicialization in Brazil, with a notable growth in lawsuits filed year after year. This scenario has generated debates about the scope of this significant fundamental right and its repercussions on the judicial administration and public budgets. This paper studies the position adopted by the Federal Supreme Court in the field of the right to health, through an evolutionary analysis of its jurisprudence. To this end, it is necessary to study the dissent of understandings of the STF Ministers and their positions based on objective criteria, as well as the indiscriminate access to the Judiciary. On the other hand, the obligation to preserve the Social Right to Health, taking into account the principle of human dignity. Finally, the guaranteeing jurisprudential stance, with the balance between the needs of the citizen and the rationality of public policies in health issues, which, when faced with doubt, mostly, protecting and giving effectiveness to the Right to Health through decisions protective measures of the Judiciary
