Resumo: |
The purpose of this study was to identify the public law framework applicable to the rendering of public services by entities of private law, that integrate or not the indirect Public Administration. The justification of this study consists on the need of explaining such regimen considering the active and passive legal situations of public law of such private entities, allowing even an appropriate comparison. In view of such premises, the study aimed to respond the following main question: which are the active and passive juridical situations of those private providers of public services created by rules of public law? From this question arises another one, answered by this study: what is the difference between those public law situations when the provider of the services is an entity of the indirect Administration or a private entity that does not integrates the Public Administration structure (concessionaires, permissionaires or grantee)? For the elaboration of this thesis, a methodological approach was used considering the Brazilian positive law. Therefore, the analysis was dogmatic and not zetetic. And, more than that, the study of this object was oriented by the three dimensions of the dogmatic proposed by Alexy, namely, the analytical, empirical and normative dogmatic |
