Resumo: In order to foment social inclusion and fight prejudice and discrimination, the compensatory law No. 8213 of 1991 establishes an affirmative action policy determining the recruitment of disabled workers through a quota system. Thinking in this group, which is inserted in a new social space by a law, this research seeks to understand how a person with disabilities is inserted in the labor market and reflect on the distance between application of the compensatory law No. 8213 of 1991 and work activity of a person with disabilities. As theoretical foundations, we based this research, from the point of view of language, in the enunciative-discursive assumptions developed by Dominique Maingueneau, with emphasis on notions of enunciative scenes and paratopia. We use the principles of Ergology, multidisciplinary approach proposed by Yves Schwartz and his team, called the “Manifesto for an ergo-engagemente”, which understands the work as a singular activity on which a man mobilizes your body and your mind from social, cultural and historical aspects that pertain. From the methodological point of view, we proceed to the discursive and ergological analysis from the manual published by the federal Government in 2007 "The inclusion of person with desabilities in the labor market”, in order to understand the reasons of the creation of the law of quotas. We also proceed, based on some of the principles postulated by the Ergonomics of the activity, to the observation of the activity of a person with visual impairment in their working environment, in order to understand this insertion. From the corpus and the employed theoretical and methodological underpinnings, was possible, therefore, propose that people with disabilities are included in the labor market, through this affirmative action in question, belongs to a paratopic group, that is, they are and are not, at the same time, legitimized in working space
