This work analyzes the social assistance in the systems of social protection of Brazil, France and Argentina, favoring two parts: the transition from the assisting forms of the private field to the public field and its relationship with the social security. The chapter 1 approaches the French social assistance policy as one of the main points of the social protection system, taking as the initial point the constitutional history contents. It marks the transition moment of the first features of the public assistance and the following configuration because of the social securities. It includes aspects of the juridical reform of the social assistance of 1953 and it presents the tensions on the devices and on the basis of Law already installed since the Minimal Insertion Income. The chapter 2 analyzes Argentina. The passage process of the beneficence and the inclusion in the apparatus of the State in the first assisting forms, the activities of the Eva Perón Foundation, concomitantly to other protection forms of the State. It makes a profound study in the juridical perspective of the social security and the social assistance. It indicates the challenges that were placed in the middle of the 1980 decade in face of the decentralization of the social services and programs. The chapter 3 studies Brazil. It presents the assisting activities during the transition of the Imperial Brazil to the Old Republic. It evokes the creation of the Brazilian Legion of Assistance (LBA Legião Brasileira de Assistência), the Constitutions formats of the 1934 and 1946 and the relationship with the working legislation. It retakes the debate over the State role starting on the international discussions over social security. It accentuates the objective that prevails in the definition of the social security in the period before the Constitution of 1988. It indicates the path of the political construction of social assistance after 1988 in face of the decentralization and the social protection network. The final considerations offer indications and show the tensions that contribute to a better delineation of the social assistance place in the passage of the private forms to the public ones, in the centralization and in the processes of political-administrative decentralization of the decade of 1980, using as a reference the experience of the three countries |
