The work develops investigations regarding the model of decision-making paradigms planned in the Brazilian Code of Civil Procedure, notably to explore the normative dimension of the universalizing decision-making unit projected from judicial pronouncements built in the situations of judgments stamped in art. 927 of the CPC. The research adopts five fundamental thematic axes, namely: 1) law in its propaedeutic perspective as a consistent platform for understanding the legal phenomenon; 2) the correlation between law and text based on the relevant role played by language; 3) logical-semantic constructivism as an adequate method for observing the universe of law; 4) the consolidation of decision-making judicial activity as a vector of law production and generator of general and abstract normative units; 5) the normative amplitude projected in the decisions elaborated with ballast in the paradigmatic procedural system. From a remodeled perspective of the nature of the judicial activity, the work explores the procedural system of production of decision-making standards foreseen in the articles 926 and 927 of the CPC, for that, incursions are promoted in the field of the sources of the law and its correlation with the universe parameterized decisional. The normative dimension projected by the decisions formatted in the judgments foreseen in art.927 of the CPC is the central theme of the thesis, notably the demonstration of the importance of the activity of demarcation of the normative decisional unit with sufficient potential to radiate effects of universalizing amplitude (ratio decidendi) |
