The work aims to study the complaint in the Brazilian Code of Civil Procedure of 2015 and its use in the control of binding precedents. The binding nature of judicial decisions established by the Code imposes the establishment of tools to control decisions that violate binding precedents. Beyond controlling errors in precedent application, the system must ensure its oxygenation, and the complaint also serves this purpose. However, given the design of the Brazilian appellate system, some decisions will not be subject to judicial review. Particularly concerning the incorrect application of legal doctrine or ratio decidendi and in cases where it is necessary to resize or overcome the legal norm of the precedent. In these cases, the complaint emerges as an important element to, in the exercise of the tribunal's implied powers, control, refine, review, and even overcome the precedent's norm. Nevertheless, higher courts have presented a contrary understanding regarding its use for this purpose. Thus, the study revolves around this issue and the contemporary functions of the complaint in light of the precedent, which can be reviewed, resized, or overcome through the complaint. The procedural steps to be observed for the complaint to play this role were addressed, emphasizing adversarial proceedings, broadening the debate, publicity, and justification. Finally, procedural aspects of the complaint in light of the Brazilian Code of Civil Procedure were highlighted |
