Resumo: |
The following thesis aims to analyze the possibility of implementation of the willful blindness doctrine in cases of improper omissive crimes committed with dolus. In a first stage, it intends to examine the concept of the willful blindness doctrine, relating it to its application in the common law systems and civil law systems (on this second point, it investigates the obstacles regarding the implementation of the mentioned doctrine in the Brazilian legal system). In a second phase, it examines the dolus theory in Brazil and its comparison to the dolus acknowledged in North America. Then, the dissertation analyses improper omissive crimes and its specifications in Brazil, detailing its application in Criminal Corporate Law. At last, the present thesis analyzes the normative theory of dolus and its application in cases of improper omissive crimes in which the agent willful abstained from acquiring the knowledge regarding relevant facts |
