This research looks at the evolution of some concepts of fundamental rights after the technological era. The topic is relevant insofar as much of the Brazilian legislative system is not adapted to new technologies, nor is the judicial system. In this context, the study aims to draw a parallel between the traditional concepts present until then in the legal environment and their evolution in the face of the conceptual novelties brought about by the technological/cybernetic/virtual universe. Among the points to be addressed in this research are: The adaptation of legal concepts such as correspondence, honor and image, for example, to the current problems brought about by new technologies; The limitation or extension of the scope of the responsibilities involved in virtual crimes; The way to hold conduct accountable that did not yet exist when much of the legal principles were thought up. The research is based not only on the evolution of fundamental rights concepts, but also on the evolution and protection of contemporary concepts and definitions involving, for example, data and information. This dissertation analyzes, above all, the main virtual crimes, such as the invasion of a computer device, virtual rape, disclosure of secrets, violation of correspondence and computer interception. It can be seen that the law is still a long way from the ideal scenario, in other words, from providing adequate protection for crimes involving a large part of the technological developments in various segments. In view of this, it is necessary to debate these issues and analyze them in the light of new technologies, since the law must keep pace with developments in this area and face up to the problems brought about by this irreversible new reality |
