This thesis aims to analyze and review the legal treatment given to the fight against international trafficking of children and adolescents in Brazil, especially under instrumental terms. The study starts with a research on the value of the dignity of the human person; then, it proposes that priority attention is given to children and adolescents, due to the condition of development and state of vulnerability of these individuals. Subsequently, a protection of personal dignity in the context of international trafficking of children and adolescents is investigated by a two-fold approach. Firstly, it is addressed the international system of protection and fight against trafficking, highlighting the influence of the external environment in the development of domestic law. Secondly, it is pointed out the recent inclusion of the human trafficking in Brazilian legal order, mainly stressing the existing lack of tutelage of children and adolescents. The study briefly shows the legal protection in force in Mercosur’s member states (Argentina, Paraguay and Uruguay), the United States of America, Portugal and the United Kingdom. From the point of view of material law, it deals with the constitutional guideline of the criminalization of the conduct of human trafficking, the legal instruments to confront it in Brazil, and, finally, analyzes the typology of this crime (article 149- under drafting of Law n.13.344 / 2016). The thesis points out the failure of the contemporary Brazilian legal system in providing adequate solutions to define the typology of human trafficking crime and proposes the improvement and development of the system in order to make effective the legal instruments in this area. This issue demands further attention that goes beyond the legal scope, requiring inter and transdisciplinary studies that cover the law and its interaction with several fields of knowledge, including anthropology, education, social sciences, sociology, philosophy and criminology |
