Resumo: Sharing economies, such as Uber, have become major labor force contractors in the country, challenging labor legislation in several countries. In the context of the current economic crisis that our country is experiencing, this new form of business has gained strength, raising questions about its legitimacy and validity. Based on the business model of the company Uber, this study aims to analyze the issues related to the new segment of the emerging proletariat in this new panorama - the precariat. Through reports from Uber drivers and documents attached to procedural records, this research sought to identify the profile of this worker, relating it to the precarious class and verifying the existence of a formal employment relationship. At the end of the study, it was concluded that it is possible to fit the driver to the concept of employee of the local Consolidation of Labor Laws, given all the requirements of the employment relationship, and that the Uber business model may come to configure the practice of social dumping from reports contained in the procedural records in which this company appears as a party.
