Resumo: This work aims at analyzing the penitentiary system of Brazil in the light of the principle of human dignity, human rights and the right of integrity of its internees. As part of this study, it was mentioned some relevant theories of penalty adopted in penitentiaries throughout the history, from the concept of corporal punishment to the most recent theory of ressocialization. According to the data collected, the existing public infrastructure and services of the penitentiaries is far from providing means to ressocialize the prisoners. In a comparison made between public and private models, it was observed that most public penitentiaries deal with the internees as a human thing, contrary to the private models, in which the internees have the human being rights mostly respected. Although the privatization of services in the penitentiaries has been more effective than the public ones, not all services can be privatized. Under these circumstances, the Author proposes some changes in the present model of privatization, restructuring the management of the penitentiaries, implementing the theory of ressocialization in this system in line with the principles protected in the Constitution
