The objective of this work is to study disobedience as a fundamental right for the protection of the Constitution, democracy, and human rights. Additionally, it aims to analyze the treatment that national law, comparative law, international law, and the Brazilian Supreme Federal Court give to the right of disobedience. To achieve this goal, the chosen path is divided into three parts: (a) the study of obedience to the law; (b) the analysis of the right to disobedience; and (c) considerations about the fundamental duty to disobey. Along this path, various paradoxes regarding the theme of resistance are identified and detailed in the conclusions. The work also delves into the foundations and dangers of obedience (the banality of evil), the inseparability, for the purposes of this thesis, of the democracy/disobedience binomial, questioning the theory of peaceful disobedience, affirming the existence of an implicit positivation of the right of resistance in the Brazilian Constitution, resistance through humor, and even the possibility of disobedience operated by artificial intelligence.
