Resumo: In this paper I will demonstrate the need for a guardian ad litem to the institutionally sheltered child and adolescent. To this end, the paper aims to explain the various stages of the institutional sheltering system in Brazil and in some other countries, from the initial shelter to the exit of the minor from the shelter system, either through reinsertion into the biological or extended family, through adoption, or through exiting the institution upon reaching the age of majority. I will show with this research the differences between the sheltering systems in some countries of the European Union and the United States of America, which prioritize family foster care over institutional sheltering, unlike Brazil, where children and adolescents are mostly sheltered in public or private institutions. These countries also use society to protect minors while they are fostered and have specific laws that guarantee that each minor can have his or her guardian in an individualized way to look after their interests and guarantee their fundamental rights, which are extremely necessary for the protection and development of each one. I will also demonstrate the benefits of having a guardian ad litem appointed to each child in order to guarantee his or her rights and to give voice to his or her wishes and needs. Finally, I will suggest the creation of a law so that these minors can have more attention, security, and well-being while they are sheltered and waiting for their lives to be defined
