The present work aims to study the possibility of using the institute of civil liability as a mitigating and solving form of the problems caused by the dissemination of fake news on digital platforms. To this end, research was carried out on relevant aspects, such as the history of the internet, the evolution of social networks and the way of obtaining and disseminating information through them. Aspects related to the internet and social networks and the ways in which these technologies have changed the world were analyzed and, in more detail, fake news was addressed, bringing its history and relevant data on the form and capacity of dissemination of this species. of content. Then, civil liability is approached, drawing a parallel between its functionalities and the criteria necessary for its configuration in practical cases related to fake news that have already occurred, approaching from the possible offending agents, the unlawful acts committed, the damages suffered by the offended and the causal link between them. In conclusion, the use of civil liability functions is addressed as a way to solve the problems caused by the dissemination of fake news. |
