Resumo: |
This paper is about isolated productive units (UPI), specifically about its concept and context, at the insolvency of commercial companies. The study is approached in 7 sections: brief considerations upon insolvency, brief considerations about commercial establishments, concept of UPI, UPI in judicial recovery, UPI in extrajudicial recovery and in bankruptcy, cases and conclusions. By analyzing the matter, this paper aims to demonstrate that UPI’s nature is aligned with two of the most important principles that should guide the modern treatment of insolvency, namely: maintenance of economic activity and recovery of the companies in crisis. Likewise, the study aims to approach the conceptual issue. In other words, how UPI can be defined, what can be classified as UPI and which are the consequences of adopting one or another understanding. In addition of doctrine, this study analyzes concrete cases, statistics and court decisions |
