A autonomia procedimental da tutela antecipada antecedente em relação à estabilização dos seus efeitos

Resumo: Miguel Reale’s tridimensional theory of law justifies the edition of the Civil Procedure Code in 2015. As a value, Democracy, alongside the Judiciary’s satisfaction crisis as fact, gave a boost to the creation of a complex of standards which adopted efficiency and instrumentalism as founding paradigms. The same dynamic must be noticed in provisional remedies. For this reason, the CPC/2015 structures the provisional remedies with the same instrumental and effective approach. The elements of provisional remedies stop being conceived in such static form and begin to own a dynamic and fluid relation, from a dialectic of implication and polarity in such way it can be observed in Reale’s tridimensional theory of law. There is, therefore, a relation of complementarity between the fumus boni juris and periculum in mora that, when conjugated, creates an elementary unity between the provisional remedies. Monitoring the provisional guardianship’s dynamic movement, the CPC/2015 establishes the interlocutory relief requested in the complaint’s special procedure conceived to assist (not exclusively) the situations which the urgency corresponds to exorbitant degree when compared to the probability of the alleged claim. The stabilization of the interlocutory relief requested in the complaint’s practical effects on its own is one of the possible results of the procedure. It has been demonstrated from the fluid conceptions and elementary unit of the provisional remedies that is not possible to compel the result of the stabilization to those which the provisional remedies is valid. This way, as an option of the procedural system, the res judicata cannot be separated from the one who opts for the this rite. There is, therefore, between the procedure of interlocutory relief requested in the complaint and the stabilization of its effects a procedural autonomy, which gives the plaintiff the free choice for the result which favors himself in the best way
