Resumo: The first chapter of this study is dedicated to accurate analysis of Labor Union Organization in Brazil, which is carried out through comparative investigation with foreign systems and the OIT international regulations. Approached in this chapter is the dichotomy between freedom of association and Union unicity, especially their coexistence in the 8th article of the Constitution. In the final part of this section the scarce representation of Unions is scrutinized, and analyzed the rules presented by the proposition for reform of Labor Union Organization currently discussed in Congress. In turn, the second chapter presents the National System of Class Action Lawsuits, comprised by the regulations contained in the “Class Action Lawsuit Law (Law 7. 347/85), and in the Code of Defense of the Consumer (Law 8. 078/90). Furthermore, the primal distinction between collective rights defense and collective defense of rights, as well as the forms of legitimacy in the different sorts of Class actions. The third and last chapter brings the specific analysis of the legitimacy of Unions in the Class Action Lawsuits, mainly in virtue of a precedent from the Federal Supreme Court. Following the study of important contributions by the American pattern of Class Action Lawsuits, the necessity for judgement of adequacy of representation in each case and the notice of the class members, principally in face of the diminutive representation of Unions. Finally, the conclusion is reached that the solution adopted in Brazil, in affairs which present collective binding effect, is in illogical conflict with the principle of judicial economy, which is the very genesis of the Class Action Lawsuit.
