Resumo: | The present study purposes to discuss the lawfully of the jurisdictional activity, based on the work of Chaïm Perelman, called “Juridical Logic”, observing the research line ‘Hermeneutic, Justice and Constitutional State’. The approach of this study is related to judicial decisions of real cases, and not about the constitutionality control. The first chapter presents the elements of the traditional model: the State of Law, the Balance of Powers, the Democracy and the Positivism. In the second, these elements are questioned and faced to present situation. This procedure aims to adequate them (the elements) to the reality. The third chapter is about the problem of positive law. It is related to the gaps, antinomies and to the mistakenly of the juridical terms, as well the possibility of undoubtedly unfair decisions. The fourth examines the philosophical hermeneutics and their deeply unfolds on the juridical phenomenon. The fifth analyses the dialectical concept of Science, initially presented by Aristóteles and developed by Perelman. Finally, the sixth chapter presents two examples: one of civil law and one of penal law. It results from the modern construction of the law and aims to show that the jurisdictional activity – based on principles, rules and values of the juridical arrangement and, since the fundamental rights and the dialectical lawsuit in the inquiry of consensus are assured – finds democratic grip. |
