Resumo: The present paper, connected with the research line called Efficacy and Effetiviness of the Constitution and the fundamental rights in the public and private Law in the PUCRS’s Master of Law, analizes the relation between fundamental right to health and its control by Justice. In this research, our mainly concern is the efficacy of the fundamental rights of second generation and if is possible to demand it, been only indirectly analized the aspects of effetiviness and efficiency. The subject demands to put the right to Health in a context in the wide range of modalities under its protection by many fields of Law in way to demonstrate that the debate goes beyond the simple claim of the 1988 Federal Constitution. Into this interation between the various fields of Law, is very important to regard the defense of the existencial minimum that can be ask to State in order to government do not remain restricted a negative posture and accomplish its promotional function delimited by the higher Law and projected by the Law theory. In this way, the State sees its question of interpretation reflection in the idea os Constitucional State, giving the law principles the necessary strenght to justice to control the government in the execution of health policy in Brazil. The principal question is how to give efficacy and effetiviness to the fundamental rights of second generation preventing the speech of public interest, of convenience and opportunity that obstructs the legitime beneficts by the citizens of the existencial minimun then, the separation of powers must be understood like a principle which tends to harmony in direction to the society projected by the Constitution of 1988.
