This dissertation, linked to the line of research in Criminology and Social Control of the Graduate Program in Criminal Sciences of the Pontifical Catholic University of Rio Grande do Sul, sought to investigate, looking from the international instruments of protection of women, to what extent the rules and regulations existing in Brazil and Mozambique, directed towards the protection of women against violence in the family, are effective to guarantee those rights. This type of research was chosen by the interest to put in check the existing legislation and be what more adapt to the objective of the survey. The specific objective of this research was basically the confront the applicability of the existing legislation relative to protection of fundamental rights and duties and the problem of violence against women in famíilia in both countries: Mozambique and Brazil.
