Resumo: | The federative form of state constitutes a structural principle, besides intangible clause of brazilian state. For federacy, beyond consolidate on a rigid and constitutional written, which there are rules of competence, assecuring autonomy to the members, is essencial, though, the existence of a specialized institution, with endowed imparciality, with attribution to decide federactive conflicts and that it assures the fulfilment to the Constitution. In United States, this function is exercized by U. S. Supreme Court, with judicial review, and their decisions have effects according to the american legal system. In Brazil, this function is realized actually by Supremo Tribunal Federal, perhaps reasons from historical, political and judiciary nature justify his lateness compared with american model, even though stablished since Constitution of 1891. An hermeneutic-systematic effort, balancing opposite principles, specially in the conflict autonomy v. unity, has been founded in a large kind of decisions, that comprove this understanding. |
