Resumo: The current work aims to analyze the process of law constitutionalization, especially its origins, theoretical premises and possible consequences. Concerning Administrative Law, this process of constitutionalization has reflexes over the transformation of an authoritarian model of administration towards a consensual model. Therefore, the traditional paradigms of Administrative Law either acquire new forms or are completely overcome. Thus, instead of the supremacy of public interest, Administrative Law becomes dominated by fundamental rights, remarkably the fundamental right to an adequate public administration. Furthermore, the principle of legality is overcome by the principle of judicialization. The traditional dichotomy between “bound administrative act versus discretionary administrative act” is overcome by the mandatory connection between administrative acts and fundamental principles. Finally, the current work aims to analyze the administrative police power from the perspective of fundamental rights. In this context, a preventive and promotional posture plays an important role, as well as the double function of the proportional principle: the prohibition of excess and the prohibition of insufficient protection.
